Terms of Service

The administrator of the CrashBreak service, available at http://crashbreak.com, is Michał Janeczek, who runs a business under the name “CrashBreak Michał Janeczek” with its registered office at Uchań Dolny 7, 99-420 Łyszkowice, Poland, registered in the Central Registration and Information on Business (CEIDG) and using the Tax Identification Number PL8341883631. Contact with the administrator is available via the e-mail address contact@crashbreak.com.

§1 Definitions

  1. The following definitions apply to these Terms of Service:
  2. a) Administrator – Michał Janeczek, who runs a business under the name “CrashBreak Michał Janeczek” with its registered office at Uchań Dolny 7, 99-420 Łyszkowice, Poland, registered in the Central Registration and Information on Business (CEIDG) and using the Tax Identification Number PL8341883631,

    b) Account – a collection of resources established by the Service for the User,

    c) Project – IT project carried out by the User on his own or a rented server,

    d) Terms of Service – further called „Terms”, available at http://www.crashbreak.com/terms_of_service/,

    e) Service – supported by the Administrator and available at http://crashbreak.com,

    f) User – a person who created an Account in the Service.

§2 Preliminary Provisions

  1. The Terms define the terms of use of the Service and the rights and obligations for the Administrator as well as the User relating the usage of the Service.
  2. The Administrator provides services which aim is to support the User in tracking and eliminating errors created while conducting a Project (carried out by the User).
  3. The Administrator declares that the only objective and goal of the Service is to store information about the errors created while conducting a Project so that User and third parties invited by them to support the project, can access this information from any device connected to the network.
  4. The Administrator does not have access nor does he interfere with the Project.
  5. The Administrator does not provide any assistance with the Project, or with correcting errors arising in the implementation of the Project. The role of the Administrator will be limited to providing the website only.
  6. No specific technical requirements are needed for the computer or other devices to use the Service. The following will suffice: Internet access, active e-mail address, standard operating system, standard web browser.
  7. User – a person who created an Account in the Service.

§3 Account

  1. Access to the contents of the Service is available only after the User creates an Account.
  2. Filling in the registration form is needed for creating an Account. The registration form is available at http://www.crashbreak.com/users/sign_up/.
  3. The registration form requires providing e-mail address and password with which the User will be logging into the Account.
  4. It is prohibited to fill in the form with unlawful information. Given e-mail address must be active.
  5. After completing the registration form, the User must agree on the Terms of Service. Before accepting the Terms, the User should be familiar with its contents. Agreement on the Terms is voluntary but necessary to create an Account within the Service.
  6. After completing the registration form, click on the “Sign up” button. Upon clicking on the “Sign up” button, the User concludes an agreement between the User and the Administrator on running the Account.
  7. The User logs into the account using the e-mail address and password, referred to in paragraph. 3. After logging in, the user is transferred to the user panel/interface.
  8. The User has the access to the Service using the user panel/interface. The User's Projects are accessible form the user panel/interface.

§4 Projects

  1. To add a new Project the User must select the “+ New Project” and fill in the form by defining the name of the Project and, if the User wants to use additional integration with repository, Project's repository.
  2. After the Project is added, the User will see a script installation instructions enabling them to handle the Project through the Service.
  3. After the script's installation as instructed, the Project will be linked to the Service.
  4. The User can view the details of the Project in the user panel/interface.
  5. The User might invite extra entities for the Project if the subscription plan allows it. The invited entities gain access to the Project through the Service. The User is obligated to consult invited entities about the Terms and oblige them to comply with it. The actions taken by the entities invited by the User are treated as actions of the User.

§5 Errors

  1. After the script's installation in accordance with paragraph 4 of the Terms, the mechanism of the Service will monitor and track the changes in the Project.
  2. If the mechanism of the Service finds an error in the Project, the information about such error will be saved and accessible in the “Error” tab in the user panel/interface.
  3. In the “Error” folder the User can review the details of the error.
  4. In the “Deploys” folder, the User can monitor when the error occurred.
  5. The User can send additional data, information, source files or scripts of the Project to help them in fixing the errors. The administrator instructs the user not to send or upload any data that may expose the User to harm, loss of data or failure of the Project. In particular, the User should not send to the Administrator any logins, passwords or personal information.
  6. If the User wants to highlight the essential data for the Project in the Project's details, they should not send them directly through the Service but only in the form of links that allow only authorised entities to access them.
  7. If the errors are eliminated, they can be marked as eliminated on the Service.

§6 Subscription plans

  1. Creating an Account is free.
  2. The Service is accessible in the following subscription plans:
  3. a) “Hackers”,

    b) ”Companies”.

  4. Using the “Hackers” subscription plan is free.
  5. Using the “Hackers” subscription plan allows the User to add 1 (one) Project and invite 2 (two) entities for Project handling.
  6. Using the Service with other subscription plan than “Hackers” is paid. Access to the Service with other subscription plan is allowed only for:
  7. a) natural self-employed person,

    b) legal person,

  8. Using the “Companies” subscription plan allows the User to add unlimited number of Projects and invite unlimited number of entities for Project handling.
  9. “Companies” subscription plan has a monthly fee which is collected in advance for each month (30 calendar days) of the access to the Service.
  10. The amount of monthly fee is fixed at 39$ (thirty nine) dollars.
  11. The price quoted above is for all Users domiciled outside the territory of Poland. For the User who is domiciled withinthe Polish territory, the amount of monthly fee for the access to the Service as part of a subscription plan "Companies" is 120 (one hundred twenty) PLN net + VAT = 147.60 (one hundred forty-seven zloty and sixty groszy) PLN gross.
  12. With the moment the Account is created, the User is automatically assigned to the “Hackers” subscription plan. Changing the subscription plan is available at the “Pricing & Plans” tab.
  13. If the User chooses other subscription plan than “Hackers”, he/she will be transferred to the website with an order form which he/she will have to fill in with their company information in order to generate an invoice and then make the monthly fee payment. Upon making the successful purchase, a contract is concluded between The Administrator of the Service and the User. Chosen subscription plan is activated and the User can access the Service with the features of the chosen subscription plan.
  14. At the end of the month (30 calendar days) of accessing the Service with the subscription plan other than “Hackers”, the User is informed about the need to pay the monthly fee for the following month. If the payment is not made, the chosen subscription plan is deactivated and the User is automatically assigned to the “Hackers” subscription plan. In such a situation, Projects and entities invited to support the Project beyond the fixed number of the “Hackers” subscription plan are being deactivated. Their reactivation will happen on the date of the subsequent payment of monthly fee for a subscription plan other than "Hackers".
  15. Making a payment for the chosen subscription plan is possible only via PayPal.
  16. The User agrees to receive an invoice documenting the payment for the selected subscription plan electronically (via e-mail).
  17. For the User who is domiciled outside of Polish territory, the transaction is not subject to taxation in Poland in accordance with art. 28b in conjunction with art. 5 of the The Goods and Services Tax Act. VAT is paid by the purchaser (reverse charge).
  18. In the User's Account the subscription plan, its validity, and the end of which it will be necessary to pay another monthly fee in accordance with paragraph. 12.

§7 Administrator's responsibility and permissions

  1. The Administrator will make every effort to provide uninterrupted and undisturbed work of the Service however, the Administrator does not guarantee continuous and uninterrupted operation of the Service.
  2. The Administrator reserves the right to temporarily suspend the operation of the Service for maintenance purposes or upgrading (TTO). The User will be notified of the planned technical break.
  3. The Administrator does not bear any responsibility for any damage, loss or any other consequences of the Service unavailability or interruption of the Service operation.
  4. The Administrator reserves the right to cease operation of the Service (Service closing). The User will be notified of the planned closure of the website. Upon the closure, there will be no option to choose a subscription plan other than “Hackers”. The User using subscription plan other than "Hackers," will be able to use his remaining time in the chosen subscription plan. The website will eventually be closed as soon as all Members will use their remaining periods of time within the selected subscription plan other than "Hackers".
  5. The administrator instructs the User to backup all the essential data for the Project on their own or rented server (eg. AWS). Only file identifier should be sent via this service. Uploading and downloading this file should be performed only on the User's devices on his own responsibility, and Service should not have access to them.
  6. The administrator does not bear any responsibility for the User's actions contrary to paragraph. 5.
  7. The Administrator does not bear any responsibility for any damage, loss or any other consequences resulting sent by the User - in spite of being requested, referred to in paragraph 5. of the Terms – data under instruction.
  8. The administrator instructs the User that he should independently perform regular backups of the Project and to take any other steps to protect the Project. The Administrator shall not be liable for any loss of data or failure of the Project. The Service is not used for storing Project's data, nor is it used to reproduce the Project in any way. The only task of the Service is to store information about errors occurring in the Project.
  9. The Administrator reserves the right to block the User's Account, if the User is using the Service in violation of the provisions hereof or the law.
  10. The Administrator strives for the Service to operate all the Projects but does not guarantee that it will actually be possible. Therefore, the Administrator instructs the User that before selecting a subscription plan other than "Hackers", they should make a preliminary attempt to link the project with the Service to check that all the integration work properly.
  11. The Administrator informs the user that all libraries used within the Service have been developed for the latest versions of web programming languages and frameworks. The Administrator does not guarantee correct operation of libraries and announces that they are available under the MIT license with the possibility of making changes and editing. All libraries can be found at https://github.com/crashbreak. Before selecting a subscription plan other than "Hackers", the User should make a preliminary attempt to link the project with the Service to check that all the integration work properly.
  12. In the event of problems with linking the project to the Service, the Administrator is available at e-mail address contact@crashbreak.com.

§8 Personal data

  1. The administrator guarantees the confidentiality of any personal data made available to him.
  2. The personal data included in the Administrator's database are processed in order to provide the User with accessibility to the Service and these are:
  3. a) e-mail address,

    b) IP address,

    c) the information contained in system logs - for technical and statistical data,

    d) the name of the company - if the User have chosen a subscription plan other than "Hackers"

    e) the company's address - if the User have chosen a subscription plan other than "Hackers"

    f) tax identification number - if the User have chosen a subscription plan other than" Hackers ".

  4. The User can also give separate consent to receive advertising and promotional materials from the Administrator.
  5. Personal data shall be collected with due diligence and adequately protected against access by unauthorized persons, and its processing is carried out in accordance with and subject to the conditions set out in detail in:
  6. a) the Act of 18 July 2002. on the provision of electronic services (Journal of Laws of 2013. pos. 1422),

    b) the Act of 29 August 1997. Protection of Personal Data (Journal of Laws of 2014. pos. 1182),

    c) Regulation of the Minister of Internal Affairs and Administration of 29 April 2004. on personal data processing documentation and technical and organizational conditions which should be fulfilled by devices and computer systems used for processing personal data (Journal of Laws No. 100, item. 1024 ),

    d) other acts of universally binding law.

  7. The User have the rights defined in the legislation referred to in paragraph. 4, including in particular:
  8. a) access to their personal data,

    b) to require completion, updating, rectification of personal data, temporary or permanent suspension of their processing or removal if they are incomplete, outdated, untrue or collected in violation of the law or are no longer needed for the purpose for which it was collected.

§9 Cookies policy

  1. The Service uses cookies, small files that hold a certain amount of data, which can be send to your browser by the Service. It may then be stored on the Users smartphone, tablet or computer's hard drive. Cookies can be accessed by the Administrator's ICT system.
  2. The cookies are stored on User's device. Information contained in them are used for statistical purposes and in order to ensure the proper functioning of the Service.
  3. It is possible for the User to modify the configuration of the web browser to prevent the storage of cookies on the device.
  4. The Administrator indicates that the cookies can be removed by the user after they are saved by the Administrator, through the web browser, programs or use of the tools available within the operating system used by the User.
  5. The administrator shall inform the Users that changing the configuration of the web browser, which prevents or limits the storage of cookies on Users' device may cause limitation of Service's functionality. Similar effects can occur when cookies are removed while using the Service.

§10 Complaints

  1. Users can submit complaints regarding functionality of the Service.
  2. A complaint should include:
  3. a) User's information,

    b) the subject of the complaint

    c) the circumstances justifying the complaint,

    d) User's request in connection with the complaint.

  4. Complaints can be sent by e-mail at contact@crashbreak.com.
  5. The Administrator shall consider the complaint within 14 days. The User shall be immediately notified about the Administrator's decision by e-mail.

§11 Account deletion

  1. The User may delete your Account by sending the request to the Administrator's email address contact@crashbreak.com.
  2. Upon receiving the request by the Administrator, the User will have access only to the „Hackers” subscription plan. The User using a plan other than "Hackers," will be able to use his remaining time in the chosen subscription plan. Account will be removed after this period of time.

§12 Other provisions

  1. The law applicable to the assessment of the Terms of Service and agreements made with the User is Polish law.
  2. The Administrator reserves the right to make changes in the Terms of Service. The new content of the Terms will apply to the User when they accept changes of which they have been notified.
